Terms of Service

Last updated: 16 October 2026

These terms apply when a business uses Mustr. Please read section 4 carefully: Mustr helps you keep on top of health and safety records, but it does not replace your own judgement, your competent person, or your legal duties.

1. About us and these terms

Mustr is provided by BAM Digital Solutions, a sole trader business owned by Benjamin Maddison (“we”, “us”). “You” means the business that signs up, and the person who signs up confirms they can bind that business.

Mustr is for businesses only. It is not offered to consumers.

2. The service

Mustr lets your crew report incidents, near misses and site records on WhatsApp. It drafts RIDDOR and CDM paperwork, tracks deadlines, collects toolbox talk and policy sign-offs, reminds you about accreditations, and builds evidence packs, all shown in your dashboard. We may improve or change features over time, and will tell you before removing anything you rely on.

3. Your account

  • Keep your sign-in email secure. You are responsible for what happens under your account.
  • Only add crew members who have agreed to receive Mustr messages on WhatsApp, and keep their details up to date.
  • Do not use Mustr for anything unlawful, to send spam, or to try to access other customers’ data.

4. Mustr supports compliance. It does not replace you.

  • You remain responsible. Your legal duties under the Health and Safety at Work etc. Act 1974, RIDDOR 2013, CDM 2015 and other law stay with you. Using Mustr does not transfer them to us.
  • Mustr does not report to the HSE. Mustr drafts reports and tells you when they are due. You must check each draft and submit it to the HSE yourself, on time.
  • AI can be wrong. Mustr uses AI to suggest whether an incident may be reportable. A suggestion is not legal or professional advice. Check every classification and draft before you rely on it, and get advice from a competent person when you are unsure.
  • Not a replacement for a competent person. Mustr does not replace the competent health and safety advice the law requires you to have, risk assessments, or first aid and emergency arrangements.
  • Not an emergency service. In an emergency, call 999 first.
  • Mustr covers the frameworks listed on our website. It does not check COSHH or work at height yet.

5. Free trial, plans and payment

  • New accounts get a 14-day free trial. No card is needed.
  • After the trial, you need a paid plan to keep using the dashboard. Plans and prices are shown on our website and in your dashboard when you subscribe. Prices are per month and billed in advance through Stripe.
  • You can cancel at any time from Billing in your dashboard. Your plan runs to the end of the period you have paid for, and we do not refund part months unless the law requires it.
  • We will give you at least 30 days’ notice by email of any price change, and you can cancel before it applies.
  • If your trial or subscription ends, Mustr keeps accepting incident reports on WhatsApp so no safety record is lost. You need an active plan to see and use them in the dashboard.

6. Your data

Your records belong to you. We process them only to provide Mustr, as set out in our Data Processing Agreement, which forms part of these terms, and our Privacy Policy. You are responsible for having a lawful basis to collect the data you put into Mustr and for telling your crew how it is used.

You can export your records as an evidence pack from the dashboard at any time while your plan is active, or ask us for a copy when you leave.

7. Availability

We aim to keep Mustr running at all times but cannot promise it will never be unavailable, for example during maintenance or when a provider such as WhatsApp has an outage. Keep your own process for urgent reporting so a delay never stops you meeting a legal deadline.

8. Our liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.
  • We are not liable for fines, penalties or losses that result from your own legal duties, including a late or missing report to the HSE or relying on a draft without checking it.
  • We are not liable for loss of profit, revenue, business or goodwill, or for indirect loss.
  • Otherwise, our total liability to you in any 12 months is limited to the fees you paid us in those 12 months.

9. Ending these terms

You can stop using Mustr and close your account at any time by emailing ben@bam-digitalsolutions.com. We may suspend or end your account if you seriously breach these terms or do not pay, and will give you notice first where we reasonably can. What happens to your data when your account closes is set out in the Data Processing Agreement.

10. Changes to these terms

We may update these terms. We will email you about significant changes at least 30 days before they apply. If you keep using Mustr after that, the new terms apply.

11. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
